Tens of
thousands of AFSCME members are at risk of losing overtime
rights under the proposed Department of Labor regulations.
Senator Tom Harkin (D-IA) will offer an amendment to the
Labor, HHS, Education Appropriations bill that would prevent
the U.S. Department of Labor (DOL) from issuing any
regulation that takes away workers
overtime rights.
We expect that the Harkin Amendment will be offered during
the week of July 14th, probably on Wednesday, July 16th or
Thursday, July 17th.

Additional information on the overtime proposals
The Fair Labor Standards Act (FLSA) requires public and
private sector employers to compensate their workers for
every hour worked over forty at a rate of time and a half.
Workers in the public sector may elect to take their earned
overtime in the form of pay or comp time. Workers in the
private sector always receive their earned overtime in the
form of pay.
On March 31, 2003, the Bush Administration proposed new
regulations that would eliminate the right to receive
overtime, whether in the form of pay or comp time. Tens of
thousands of AFSCME members and approximately eight million
workers nationwide will be stripped of their statutory right
to receive overtime at a rate of time and a half for every
hour worked over forty in a seven day week
The regulations pertain to professional, administrative, and
executive exemptions, which are commonly referred to as the
"white collar" exemptions and govern minimum wage and
overtime pay requirements in both public and private sector
workplaces. DOL's changes would make it much easier for
employers to reclassify workers more broadly as "white
collar" employees ineligible for overtime.
Workers likely to lose their eligibility for overtime pay
work include mid-level office workers, secretaries, licensed
practical nurses and dental hygienists, firefighters,
policemen and women, EMT's, paramedics, cooks, paralegals,
engineering and health technicians, dieticians, social
workers, administrative and computer support, and
lower-level supervisors. AFSCME members working at highly
skilled jobs in such departments as human resources, labor
relations, budget, and planning could lose the right to
overtime pay.
The DOL proposal would force workers to work longer hours
with no extra pay or time off. Millions of workers depend on
overtime pay to make ends meet, and in 2000 overtime pay
accounted for about 25% of the income of workers who worked
overtime. Many public sector workers depend on their comp
time in order to care for their children and elderly
parents. Workers stripped of their overtime protection would
end up working longer hours for less pay.

+ People with training or education that helps them do their
jobs, including military training, skills training, medical

+ The Bush administration will change the rules that
determine who is and isn't an overtime-ineligible supervisor
and cut overtime for millions. People who make $22,100 could
more easily be classified by the Department of Labor as
executives and lose all of their overtime pay. An executive
who makes $22,100?
+ Not a single public hearing on this issue has been held or
even scheduled by the Bush administration. The public has
been able to comment only through our outreach and your
activism.

Curry for his remarkable speech on Thursday that took place at
FIU. I am a future educator and skipped class to attend the
rally. I am for the boycott and have photo copied 300 copies
of the flyer that was handed out and have been distributing
them throughout the campus. My only concern: I do not know if
people are aware that the Florida Lottery is the main source
of the Bright Future's Scolarship that pays 75% of tuition for
students in financial need and have aquired a certain GPA. By
boycotting the Lottery many students will be not be able to
attened college because of the lack of funds. (I would have
been one of them)....Just wanted to inform...

The House and Senate are about to take up the
tax cut and possible fiscal relief for state and local
governments. The House will likely consider a bill this week and
the Senate next week. At this point neither the bill drafted by
the Senate Finance Committee Chairman, Sen. Charles Grassley,
R-Iowa, nor the bill put forth by House Ways and Means Chairman,
Rep. Bill Thomas, R-California, contain any new fiscal relief to
the states, cities or counties. In fact, to make matters worse,
the Grassley bill actually deprives the states of $ billion in
revenues over three years through the phase-out of taxation of
dividends. Several amendments providing fiscal relief are expected
to be offered when the Grassley bill reaches the Senate floor.
States and local governments are continuing to suffer and the
cumulative three-year budget overruns are approaching a staggering
$200 billion. All programs are being sacrificed as states are
cutting aid to local governments for education, health care
services, homeland security needs, corrections, law enforcement
and much more.

The Florida Senate wants to turn the clock back on campaign
finance reform. The Senate, with the exception of Senators Bill
Posey (R) Rockledge, Mike Haridopolos (R) Melbourne, Rod Smith (D)
Gainesville and Ron Klein (D) Delray Beach, is proposing to bring
back "leadership funds." These funds allow legislative leaders and
those seeking to become leaders to strong arm special interests
for big money donations. "Leadership funds" provide a direct $$$
pipeline from the special interests to the legislative leadership
and contributions are often contingent on favorable treatment.
At the urging of Common Cause Florida, "leadership funds" were
banned in 1990. Senate President King has placed language to
reestablish "leadership funds" in CS/SB 1500, a "must pass" bill
implementing the new federal election reform legislation. Please
call or e-mail Senator King and your local Senator and tell them
we don't need to bring back "leadership funds." Time is short,
only a few days till the session is scheduled to end.

Background: On April 2, 2003 the White
House officially nominated right-wing extremist Daniel Pipes to
the Board of Directors of the United States Institute of Peace
(USIP), and the
nomination has been referred to the
Senate Committee
on Health Education, Labor and Pensions for approval. As the
Washington Post has written, when many first heard the news they
thought it was a joke. Pipes, perhaps best-known recently for
launching “Campus Watch”, a surveillance network and website
reminiscent of the McCarthy era, has not only been widely
criticized as a racist, particularly with respect to Arabs and
Muslims, but noted for advocating the use of force and fear rather
than negotiation as the means of choice for conflict resolution.
With Campus Watch, “a showcase for the signature distortions on
which Pipes has built his twenty-five-year career..Pipes and
supporters have been able to expand their attacks into a virtually
limitless campaign of harassment and intimidation” (1).
“I know,” writes Yale Professor of History, Glenda Gilmore in a
recent article (2),”because
I have been branded a traitor. I wrote an op ed in the Yale Daily
News and received death threats and rape wishes...Within a month,
Daniel Pipes had reached millions of people around the world.”
Gilmore and Columbia History Professor Eric Foner together have
characterized this in kind with the most “shameful anomalies in
the history of civil liberties” (3).
When Jim Sleeper, who also teaches ethics and political science at
Yale warned of the “neo-Stalinism wafting up” from these
activities he, too, found himself on the pages of Campus Watch (4),
and subject to a national smear campaign (5).

Lines 410-419 of the Senate budget (SB 2500) in
proviso language stating: "The Department of Children and Families
may use a private contractor to finance, design, construct and
operate a replacement facility for the South Florida Evaluation
and Treatment Center in Miami."
The Senate Budget was passed unanimously, including all members of
the Miami-Dade delegation. The House and Senate now are in
negotiations called a conference committee to hammer out
differences between their two budgets before sending a final
spending plan to the governor.
This privatization is being pushed by the Wackenhut Corporation,
which has donated $200,000 to Florida politicians and political
parties in the last year alone.
HERE IS HOW WE CAN FIGHT THIS PRIVATIZATION
As many people as possible need to call, fax, e-mail and even
visit members of the Miami-Dade delegation, especially Rep. Marco
Rubio, R-Miami, who is House Majority Leader.
Many calls, faxes, e-mails and visits too need to be made to House
Speaker Johnny Byrd, R-Plant City; House Budget Chairman Bruce
Kyle, R-Bradenton; Senate President Jim King, R-Jacksonville; and
Senate Budget Chairman Ken Pruitt, R-Port St. Lucie.
It is not enough just to call your legislators and the leadership.
You need to make contact with every representative and senator so
that they are aware of this issue.
Write letters to the Miami Herald, Sun-Sentinel and other
publications. Call up television stations and ask them to cover
the issue.
Ask your friends, family, neighbors, churches, businesses,
community organizations and everyone else also to make contact
with the Legislature.

We've organized a great demonstration against the NRA at their
annual convention in Orlando on April 26 (please see enclosed
flyers for more details).
Nine children are killed everyday in this country by gunfire.
On behalf of all children we are asking you to help us get the
message to the national media that the NRA blocks even the most
basic protections for children and fights the renewal of the ban
on assault weapons (weapons of war like Uzis and AK47) which is
set to expire next year. They say any regulation, including
child safety devices, is a "slippery slope" to taking away their
guns!

P.S. Here's a report from Diane Jones, the MoveOn member who
pulled together the petition delivery on Monday:
Dear MoveOn supporters,
In a week's time, you helped us deliver the fastest-growing
petition we've ever seen to each of the 15 U.N. Security Council
member nations. The meetings with Security Council members were
accompanied by a press conference that helped to get our message
out across the United States and beyond.
To give you a sense of the scale involved, each copy of the
petition was twelve boxes' worth of paper. These boxes served as
an impressive backdrop for our press conference, where MoveOn,
American Friends Service Committee, and Win Without War
representatives were joined by Ethan Hawke, Jessica Lange, and
Steve Buscemi -- actors who helped to show the popular appeal of
our call. CNN, ABC, CBS, NBC, Time Magazine, New York Times, L.A.
Times, People Magazine, Inside Edition, and a long list of other
media outlets were there to capture the moment.
After the press conference, over 300 amazing New York City
volunteers helped to deliver the boxes to the U.N. missions of
each Security Council country. These meetings were nothing short
of inspiring.
The coordinator of the Guinean mission meeting described her
experience this way:
"22 people attended. I [said to the Guinean representative] that
they, of all people, should vote NO WAR because they knew in their
hearts what war was like and that we only knew it from our heads.
I mentioned a letter I read from a woman who had visited Iraq
lately and wrote that Iraqis do not speak of the future because
they do not believe they have one.
He responded in English saying that Guinea was a very poor country
but that they liked being free. He said that they would rather be
poor and free than rich and-- he extended his hands in front of
him crossed at the wrists as if bound."
Even when a few of the missions would not confirm an actual
meeting, our MoveOn delegation arrived to officially present the
petition to the Ambassador's office and to get a representative to
meet with them on the spot. Cameroon's mission was one such
challenge, as described by the meeting coordinator:
"Total success at Cameroon mission today! I was blown away by the
preparation and eloquence and French-speaking (some) of the 16 or
so people who showed up to deliver the petition. After a bit of
checking [we were escorted] to a meeting room upstairs, where we
sat around a table and people shared their prepared comments.
Everyone was respectful but that didn't preclude displays of
passion and emotion. . . . [One] woman, after saying she had never
done anything like this before and was doing it because she was
scared of what might happen, said on a lighter note that the
Cameroonian Lions team had given her a lot of enjoyment over the
years, which elicited some laughs from the reps."
The German contingent also had a great experience:
"We met with Dr. Hans Schumacher, Deputy Permanent Representative
of Germany to the UN. Dr. Schumacher interrupted a meeting to meet
with us ... and gave us a warm welcome." "About 20 people
represented MoveOn.org. Lin Wefel [meeting coordinator] read from
a prepared statement about the petitions that MoveOn.org had
collected and our desire for a peaceful settlement to the Iraq
crisis.
Ambassador Schumacher welcomed the MoveOn.org representatives by
saying, 'As far as this mission is concerned, you are coming in
through open doors.' He noted that the German mission is opposed
to war as a means of disarming Iraq.
Ambassador Schumacher said his personal feeling was that the U.S.
and Britain would not be able to get nine votes on the Security
Council to pass another resolution on Iraq. He said that Germany
believes that the existing UN resolutions have sufficient
authority to disarm Iraq through vigorous arms inspections."
We have received similar, often exuberant reports from the other
meeting coordinators. It was a powerful experience -- and one you
made possible by signing the petition.

The Western Arctic is the calving ground for a caribou herd
numbering 450,000, as well as the summer nesting ground for
millions of birds from six different continents. Many Native
Alaskans, who have lived here for thousands of years, depend on
the area's caribou, waterfowl, and fish for their survival.
Known formally as the National Petroleum Reserve-Alaska, this vast
Western Arctic wilderness was set aside in 1923 for oil production
in time of pressing national need. But not even during the darkest
days of World War II or the oil embargo of the 1970s was it ever
developed.
Now, though, the Bush administration is targeting this pristine
Arctic ecosystem for rampant development. Two of its proposed
"alternatives" would lease between 96 and 100 percent of the
reserve for oil and gas development.
The NRDC BioGems Campaign is advocating full protection for 35
percent of the reserve that encompasses critical wildlife
habitats. Oil drilling would be prohibited in these habitats,
which include a polar bear denning area, a lagoon inhabited by
spotted seals and beluga whales, and a river nesting area for
peregrine falcons.
The Bush administration is taking public comments on the fate of
the Western Arctic through March 18th. Please tell the
administration to adopt a plan that responsibly balances energy
development with protecting Arctic wildlife.

determining whether Democrats dig in and stand together against
the right-wing agenda, or whether a few Senators throw away our
best hope of defending our core values.
The right wing is pushing Senator Bill Nelson to
support a judgeship for Miguel Estrada -- a dangerous, radical
conservative -- on the second-highest court in America. A
call from you now could make all the difference.
Right-wing leaders in the Senate are pushing for
an immediate vote on Estrada's nomination. Yet Estrada has
no judicial experience, and has refused to answer Senators'
legitimate questions about his views on the law and the
Constitution. The fact is, he's a right-wing ideologue. If
he wins a seat, it will skew our top courts even further to the
right.
Senate Democrats have shown remarkable unity in
opposing Estrada so far, thanks in large part to MoveOn members'
efforts, and if we succeed in stopping or slowing down his
nomination, it will be a huge victory.
Senator Bill Nelson's vote will be key. A few other southern
Democratic Senators who regularly support the right-wing agenda
are pressuring him to join them. We've got to keep Bill

Who is Miguel Estrada? We all have a right to know before
we make him a judge. Yet he's done his best to hide his
views on the law from us.
Miguel Estrada has never served as a judge before, so he's never
issued a written opinion on a case. Nonetheless he has a
reputation as a right-wing ideologue. Paul Bender, a former
Deputy Solicitor General who once supervised Estrada's work, said
he found him so "ideologically driven that he couldn't be trusted
to state the law in a fair, neutral way."**
The Mexican American Legal Defense and Education Fund, the Puerto
Rican Legal Defense and Education Fund, and the Congressional
Hispanic Caucus are among a wide range of civic groups opposing
the Estrada nomination.
During hearings held in the last Congress,
Estrada refused to answer Senators' legitimate questions about his
legal and judicial views. His silence is designed to make it
hard for Senators to oppose him.
But more and more voices are speaking out in
opposition. The New York Times calls him "An Unacceptable
Nominee" and says: "The very absence of a paper trail on matters
like abortion and civil liberties may be one reason the
administration chose him. It is also a compelling - indeed
necessary - reason to reject him."***

Saturday February 15th in New York City. I am planning on
participating along with a group of friends from the New Hope
area. Unfortunately, the NYPD has refused to grant a permit for a
march over 10,000 people. An online petition has been setup that
will then be given to the authorities in an attempt to convince
them to give us a permit.

those of us who do choose to march can exercise our constitutional

A.N.S.W.E.R. coalition in a derogatory and racist fashion -
including several Muslim groups. Interestingly enough, he made no
mention of the Pastors, Christian Groups, Veteran Groups, Jewish
Groups, or other world organizations who are also part of the
A.N.S.W.E.R. coalition.
There is something we can do about it. We can complain directly to
the companies that sell advertising on his show. We can also
boycott the same products or institutions he promotes with his
hateful, abhorrent speech and behavior. We've made a list for your
convenience below.
Please write to each and every one of these companies. Tell them
why you are no longer purchasing their wares, foods, or products.
Tell them that you won't support people like Limbaugh who insult
honest working Americans of all races, creeds and sexual
orientation - or his advertisers. Tell them you'll change the
station. Turn the channel off.
Tell them when he's OFF the air you will return to buying their
products. And please DO what you say, don't buy what they are
selling, make them feel the pressure of those who can vote with
their dollars.
Tell Rush he's gone too far this time.

Channel's board of directors and tell them what, when, and why you

There is growing momentum for solidarity in the
anti-war movement in the United States and around the world. There
have been two important calls for coordinated global mass action:
one on January 18 that is anchored in the U.S. anti-war movement
and another on February 15 that is anchored in the European
movement. Below is a statement from Elias Rashmawi, a leading
figure in the recently held world anti-war conference in Cairo,
Egypt and a member of the A.N.S.W.E.R. Coalition Steering
Committee.
The A.N.S.W.E.R. Coalition, at a press conference on Wednesday,
January 8 in Washington DC, announced an Action Plan to follow up
the January 18 National Mobilizations in Washington DC and San
Francisco. As resistance builds in the United States, it is
manifesting itself through a combination of grassroots anti-war
actions of all types and of national mass mobilizations.
To that end, the A.N.S.W.E.R. Coalition calls for a Week of
Anti-War Resistance promoting a whole variety of activities
between February 13 and February 21.

Over the next two weeks, hundreds of events will
be taking place across the country to voice opposition to the push
for war. The events are catalogued at a great website:

We suggest you check it out.
Here's the context: yesterday, Hans Blix, the chief UN weapons
inspector, told the security council that his team hadn't found
any "smoking guns." On January 27th, Blix will make a full report
to the council; he's widely expected to repeat that to date, no
evidence of Iraqi weapons of mass destruction have been found. And
according to newspaper reports, Tony Blair's "assessment of the
situation is increasingly in line with that of Mr. Blix."
Meanwhile, at the White House, Presidential spokesman Ari
Fleischer continued to make the case for invading Iraq. It's
widely believed that President Bush will use the January 27th
report by Hans Blix to the Security Council, and his State of the
Union address the day after, to launch his final push for war.
We face the prospect of an imminent war against Iraq, fought
alone. Luckily, as the British newspaper The Guardian put it, the
tides are turning. The world community wants to see the
inspections process work, and some of our closest allies are
questioning the push for war.
Throughout this month, leading up to the 27th, hundreds of groups
across the country will be holding marches, workshops, vigils, and
other events indicating the public opposition to war. There will
be major marches in Washington, DC and San Francisco. And from
Fayetteville, Arkansas, to Las Vegas, Nevada, people are gathering
to voice their concern. The events are listed at:

You can also list local events on the site if they're not already
there. We can't make any promises about the organization or tone
of the events listed at the sites. But we do feel it's important
that people speak up at this critical time. Take a look -- maybe
there's an event in your area that will appeal to you.
Of course, MoveOn will also be doing quite a bit over the next two
weeks. Next Thursday, we'll be launching a controversial and hard-
hitting "Let the Inspections Work" TV ad, supported by local press
conferences in 12 major media markets. And then on the following
Tuesday, we'll be holding meetings with members of Congress and
their staff. After less than two days, over 6,900 people are
signed up.
We've got less than a month to convince President Bush to let the

Open letter from
Robert Redford about the Bush administration's sweeping
attack on our natural heritage and environmental laws
Dear Friend,
Americans voted for many things this past Election Day, but
one thing we did not vote for was a sweeping attack on our
environment. Yet President Bush is already acting as if we
did.
If you don't have time to read my letter, then please go

them to stand up in defense of our environment.
Barely two weeks after the election, the Bush administration
repaid big corporate campaign contributors with a massive
new loophole in the Clean Air Act that will allow them to
dramatically increase air pollution and harm the health of
millions of Americans.
Days later, it was the timber industry's turn to cash in. On
Thanksgiving eve, the administration proposed new rules that
would allow it to put all 155 national forests on the
chopping block for logging and other commercial activities
without having to take public input or study the devastating
impacts on wildlife.
It's no accident these special interest handouts were
announced after Election Day. They are a radical departure
from the values of conservation that most Americans hold
dear.
But the worst is yet to come. The White House has signaled
clearly that the sacrifice of our clean air and national
forests is only the leading edge of a much broader attack
that will come early this year. It will be a determined and
systematic effort to dismantle our nation's entire framework
of environmental protection.
Last year, the U.S. Senate was the firewall that saved us
from President Bush's most destructive raids on the
environment. Not any more. Key Senate committees in the new
Congress will be chaired by stalwart allies of polluting
industries who are flat-out hostile to our environmental
laws.
Industry lobbyists are already circling, ready to plunder
the public treasures they have coveted for so long: the
Arctic National Wildlife Refuge, the Alaskan rainforest, the
Greater Yellowstone ecosystem, and many more of our last
wild places.
No one voted for these environmental disasters on Election
Day, but they will come to pass if we don't unite right now
to prevent them.
The president's campaign to undermine our environmental laws
could be derailed instantly if millions of Americans would
hold Congress accountable for its upcoming votes. The fate
of our natural heritage will be determined by a handful of
moderates, Democrat and Republican. Senators on both sides
of the aisle won close races this past Election Day by
promising to protect the environment. It's time to make them
keep their word.

Anybody out there remember the classic
sci-fi film by that name?
In it, an alien landed a spacecraft on the
Mall in
Washington ,
D.C.
and asked to be allowed to speak to the UN to deliver a
warning: disarm or you will be destroyed.
The alien, Klatu, didn’t specify by whom the
destruction would take place. He did make it plain that we
would certainly do it to ourselves, even if no one “out
there” did.
Klatu never made it to the UN, but he was able to
demonstrate to the world that those who sent him meant
business. He caused a shutdown of all power throughout the
globe at a specified time on a specified date.
From cars to trains to wristwatches, everything came
to a halt.
On January 18, there will be very large
antiwar demonstrations in
Washington ,
D.C.
,
San Francisco
, and in cities across
America
. According to George Monbiot of The Guardian ( Jan. 7, 2003 ), “On January 18, demonstrators will seek to
blockade the armed forces' joint headquarters at Northwood,
in north
London
. Three days later, there'll be a mass lobby of parliament;
at 6 pm on the day the war is announced, protesters will
gather in almost every town centre in Britain. On February
15, there'll be a massive rally in
London
.” There will also be demonstrations in cities throughout
Europe on February 15.
The idea is this: a global work stoppage,
an international sick day if you will, to take place on
Friday, February 14 to protest the war on the world
currently being waged by the Bush administration.
Monbiot goes on to add, “The [Campaign for Nuclear
Disarmament] and the Stop the War Coalition have suggested
an hour's stoppage on the day after the war begins. Many
activists [in the
U.K.
] are now talking about building on this, and seeking to
provoke wider strike action - even a general strike.”
It is we, the folks who show up for work every day, who are
providing the tax dollars to pay for this war on the
economy, the environment, worker safety, civil rights, and
on the poor. We
are the ones who keep the machine up and running.
We are the ones whose children are being shortchanged
on education, health care, and clean air and water.
We are the ones who will reap the whirlwind (or will
be sucking wind) when the bill for the administration’s
misguided and dangerous policies comes due.
A general strike early in the last century brought down the
Tsar of all the
Russias
and changed nearly a century of history.
The Communist party
came crashing down in
Poland
thanks to the solidarity of its workers.
If we choose peaceful noncooperation in maintaining a
system badly in need of course correction, we may surprise
ourselves at how quickly change can be effected. No
organization is necessary, in fact it would probably be
counter-productive.
